Please read these terms and conditions carefully before using the Imagika platform.

These Terms and Conditions govern your use of the Imagika AI image generation platform. By accessing or using our services, you agree to be bound by these terms. If you do not agree with any part of these terms, you may not use our services.

1. Acceptance of Terms

By creating an account, accessing, or using Imagika, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, as well as our Privacy Policy.

We reserve the right to modify these terms at any time. Continued use of the service after changes constitutes acceptance of the modified terms.

2. Service Description

Imagika provides an AI-powered image generation platform that allows users to:

  • Upload photos and reference images
  • Generate AI-styled images using various artistic styles
  • Access and download generated images
  • Purchase credits to use the platform

We reserve the right to modify, suspend, or discontinue any aspect of the service at any time without prior notice.

3. User Accounts

3.1 Account Registration

  • You must be at least 13 years old to create an account
  • You must provide accurate and complete information during registration
  • You are responsible for maintaining the security of your account credentials
  • You are responsible for all activities that occur under your account

3.2 Account Termination

  • You may delete your account at any time
  • We reserve the right to suspend or terminate accounts that violate these terms
  • Upon termination, your right to use the service immediately ceases

4. Credits and Payment

4.1 Credit System

  • Imagika operates on a credit-based payment model
  • Credits are required to generate AI images
  • Credit costs per generation may vary based on style and complexity
  • Credits do not expire once purchased
  • Credits are non-transferable between accounts

4.2 Payments

  • All payments are processed securely through our payment processor
  • All fees are quoted in USD unless otherwise stated
  • Payment must be received before credits are added to your account
  • We accept major credit cards and other payment methods as indicated on the platform

4.3 Refunds

  • Credits are generally non-refundable once purchased
  • Refunds may be issued at our discretion in cases of technical errors or service failures
  • Refund requests must be submitted within 7 days of purchase
  • Partially used credit packs are not eligible for refunds

5. User Content and Conduct

5.1 Acceptable Use

You agree not to use the service to:

  • Upload illegal, harmful, threatening, abusive, or offensive content
  • Violate any intellectual property rights
  • Impersonate any person or entity
  • Upload content depicting minors
  • Generate images for illegal purposes
  • Attempt to reverse engineer or exploit the platform
  • Upload malware or harmful code
  • Abuse, harass, or harm others

5.2 Content Ownership

  • You retain ownership of the images you upload
  • You grant us a license to process your images for the purpose of providing the service
  • You own the AI-generated images created from your inputs
  • You represent that you have the necessary rights to upload and use all content

5.3 Commercial Use

  • Paid plan users receive commercial usage rights for generated images
  • You may use generated images for commercial purposes subject to these terms
  • You are responsible for ensuring your use complies with applicable laws

6. Intellectual Property

6.1 Platform Ownership

  • Imagika and its original content, features, and functionality are owned by us
  • Our trademarks, logos, and brand features are protected by intellectual property laws
  • You may not use our intellectual property without express written permission

6.2 Generated Images

  • You own the rights to images generated using your uploaded content
  • We do not claim ownership of your generated images
  • You are responsible for ensuring your use of generated images does not infringe on third-party rights

7. Service Availability and Support

  • We strive to provide reliable service but do not guarantee uninterrupted availability
  • Scheduled maintenance may occur with or without advance notice
  • We are not responsible for service disruptions beyond our control
  • Customer support is provided via email on a best-effort basis
  • Response times may vary based on issue complexity and support volume

8. Disclaimers and Limitations of Liability

8.1 Service Warranty

The service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

8.2 Limitation of Liability

To the maximum extent permitted by law, Imagika shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

  • Your use or inability to use the service
  • Unauthorized access to or alteration of your content
  • Any conduct or content of third parties on the service
  • Any content obtained from the service

8.3 Maximum Liability

Our total liability for any claims under these terms is limited to the amount you paid to us in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless Imagika, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with:

  • Your access to or use of the service
  • Your violation of these terms
  • Your violation of any third-party rights
  • Your content or generated images

10. Third-Party Services

Our service may contain links to third-party websites or services that are not owned or controlled by Imagika. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.

You acknowledge and agree that we shall not be responsible or liable for any damage or loss caused by your use of any third-party services.

11. Termination

We may terminate or suspend your account and access to the service immediately, without prior notice or liability, for any reason, including if you breach these terms.

Upon termination:

  • Your right to use the service will immediately cease
  • Unused credits will be forfeited
  • We may delete your account data in accordance with our Privacy Policy

12. Governing Law and Dispute Resolution

These terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these terms or the service shall be resolved through good faith negotiations. If negotiations fail, disputes shall be resolved in the courts of Bangalore, India.

13. Changes to Terms

We reserve the right to modify or replace these terms at any time. We will provide notice of material changes by:

  • Updating the "Last updated" date
  • Posting a notice on our platform
  • Sending an email notification to registered users

Your continued use of the service after changes become effective constitutes acceptance of the revised terms.

14. Severability

If any provision of these terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

15. Entire Agreement

These terms, together with our Privacy Policy, constitute the entire agreement between you and Imagika regarding the use of the service and supersede all prior agreements and understandings.
